The following Terms & Conditions (“T&C”) govern the use of services provided by RealEZphoto.com. By booking or using our photography and related services, you agree to these terms. Please note that this document is for informational purposes and not intended as legal advice. We recommend consulting with a qualified attorney to ensure compliance with applicable laws in your jurisdiction.

Terms & Conditions - the basics

These Terms & Conditions outline the legal agreement between RealEZphoto.com (“we,” “our,” “us”) and our clients (“you,” “your”). By booking services through our website or directly with us, you agree to abide by these terms.

Services covered include:

  • Real estate photography

  • Photo editing

  • Virtual tours

  • Aerial/drone shots

  • Floor plans

  • Videography

Payments, Cancellations & Refunds

  • Accepted Payments: Credit card, PayPal, online invoice, Venmo, Square, check, and ACH transfers.

  • Retainer: A $25 non-refundable retainer is required and applied toward the total cost of services.

  • Cancellation/Rescheduling: Clients must provide at least 24 hours’ notice to cancel or reschedule. If notice is less than 24 hours, the $25 retainer will be forfeited. Reschedules within 24 hours are subject to our approval and availability.

Service Delivery & Turnaround

  • Delivery Method: Images and media will be delivered via online folder sharing (link provided upon completion).

  • Turnaround Time: Final images and media are guaranteed to be delivered within 48 hours of the scheduled shoot, unless otherwise agreed in writing.

Copyright & Licensing

  • Ownership: RealEZphoto.com retains full copyright to all photographs, videos, and media produced.

  • License to Clients: Clients are granted a limited, non-transferable commercial license for use of images and media solely for marketing the specific property photographed, including MLS listings, social media, and real estate marketing materials.

  • Duration: The license remains valid for the duration of the property’s active listing.

  • Relisting or Extended Use: Any use of images beyond the initial listing period, including relisting the same property at a later date, requires the purchase of an extended license for an additional fee (fees are subject to change).

  • Restrictions: Clients may not resell, edit, alter, or transfer images/media to third parties without express written permission from RealEZphoto.com.

Aerial/Drone Services

  • All aerial services are conducted in compliance with FAA Part 107 regulations.

  • Drone services may be rescheduled, modified, or canceled at our discretion due to weather, safety, or FAA restrictions.

Limitation of Liability

We take every precaution to provide high-quality results. However, RealEZphoto.com shall not be held liable for:

  • Delays due to weather, equipment malfunctions, or scheduling conflicts.

  • Lost, stolen, or damaged files after delivery.

  • Inaccuracies in representation of property (colors, staging, size, or MLS compliance).

  • Any indirect, incidental, or consequential damages arising from use of our services.

Our maximum liability is limited to the amount paid for the specific services in question.

Governing Law, Mediation & Arbitration

  • These Terms & Conditions are governed by the laws of the State of Florida.

  • Any disputes must first be resolved through mediation. If mediation fails, disputes will proceed to binding arbitration.

  • The losing party in any arbitration or legal proceeding agrees to cover all reasonable attorney’s fees, court costs, and expenses incurred by the prevailing party.
